Water firm to file charges vs Isuzu Pampanga?

MABALACAT -- Officials of the Mabalacat Water District (MWD) are contemplating on filing charges against Isuzu Pampanga in connection with car dealer’s alleged failure to “rectify” the problem of their service vehicle.

The MWD, on April 18, 2006, procured from Isuzu Pampanga a 2006 Isuzu Crosswind XUV vehicle, which MWD general manager Francis Dimaliwat described as “defective”.

Dimaliwat claimed the vehicle has been in and out of Isuzu’s service center since it was bought because its engine emits excessive black smoke.

With this, the MWD management is demanding for a replacement or refund of the payments on the vehicle amounting to P959,000, according to Dimaliwat.

In his letter to Isuzu Pampanga branch manager Eduardo N. Tumbocon dated August 23, 2006, MWD legal counsel Venancio Q. Rivera stated that his office will file necessary legal action against the car dealer if the latter fails to respond favorably to the demands of the water district.

Tumbocon said he welcomes the move of the MWD officials, but clarified that their company is following a certain criteria before replacing a vehicle.

He added that their service crews have already rectified the problem of the vehicle. Engineers from Isuzu Philippines have also certified that the vehicles emitting of smoke is “normal” as it carries a diesel engine, Tumbocon also said.

In his reply letter to Rivera, Tumbocon stated vehicle’s failure is still way beyond the criteria of the manufacturer to replace the unit.

The manufacturer, Isuzu Philippines Corporation, is the one evaluating if an acquired vehicle needs to be replaced, Tumbocon added. “What we can only do as a dealer is to recommend our findings to the manufacturer,” he said.

“We found the degree of failure to be rectifiable through replacement of part components as commitment stated on new vehicle warranty policy, that we will repair or replace any defective or malfunctioning part of each new vehicle including all equipment and accessories,” he also stated.

Tumbocon also apologized to MWD officials.
