Court stops Floridablanca's P90 million loan By Marna H. Dagumboy
FLORIDABLANCA -- A local court on Monday stopped Mayor Darwin Manalansan from filing an application for a P90 million loan with the Land Bank of the Philippines (LBP).
Regional Trial Court (RTC) Branch 49 Presiding Judge Jesusa Mylene Suba-Isip issued an order stopping Manansalan from getting a loan, to be used for the renovation of the municipal hall and the construction of a new commercial center.
The LBP is also restrained and enjoined from negotiating with the municipality for the loan.
In an order, Suba-Isip set a hearing at 10 a.m. on October 10 for the defendants to show cause why a writ of preliminary injunction should not be issued.
Earlier, concerned citizens and market vendors filed a complaint against the Municipal Government of Floridablanca, Manalansan, and the LBP, with a prayer for the issuance of a TRO, against the town's proposed loan.
According to the complaint, which was filed before the RTC in Guagua town, Resolution 76 authorizing the mayor to enter into a loan agreement with the LBP is "invalid" and "null and void".
It was stated in the complaint that a cursory examination of the resolution "gives the conclusion that it is inadequate and insufficient" because it does not mention the amount necessary for the renovation of the Municipal Hall and a commercial center, the sites where the supposed municipal hall and center will be built.
The complainants alleged the resolution to be "unfair and "oppressive" to the stallholders and vendors in the market in that they would be dislocated, which would naturally cause damage and prejudice to their small businesses."
