Nepomuceno wins legal bout over ABC row

ANGELES CITY -- Angeles City Association of Barangay Captains (ABC) President Robin "Bong" Nepomuceno prevailed over the issue of rightful, legal, and ex-officio representation in the Angeles City council.

Regional Trial Court (RTC) Judge Serafin David has dismissed the complaint filed by Barangay Pandan barangay chairman Alejandrino Jeremias against Nepomuceno.

In an order dated October 6, 2008, David ruled that the court of Angeles City is not the proper venue to question the resolution of the Liga Board who had earlier confirmed the election of Nepomuceno as ABC President.

A portion of the decision said: "This court finds that the questioned resolution of the Board of Directors of the National Liga within the contemplation of the Liga's constitution and by-laws has the force and effect of law, which all officers and members of the organization of the liga ng mga baragay sa Pilipinas are bound to obey and comply."

Liga Board lawyer Paulino Yusi said the order denied the earlier motion for reconsideration filed by Alejandrino on the denial of his application for a temporary restraining order seeking to prevent Liga from implementing its resolution and for Nepomuceno from discharging his functions as ABC President.

Nepomuceno welcomed the court's decision and urged all barangay chairmen here, regardless of affiliation, to now start working together as a team for the betterment of Angeles City.
