Comelec en banc proclaims Casupang brg'y polls winner

MANGALDAN -- The Commission on Election (Comelec) en banc has proclaimed Barangay Captain Rufo Casupang as the rightful winner in last year's elections for the position of chairman of Barangay Nabaluan.

The Comelec resolution signed by Comelec Secretary Benjamin Abalos also dropped the motion for reconsideration filed by Ruben Amansec who is still sitting as the barangay captain.

Casupang said the polls body did not act on Amansec's motion because he failed to pay the filing fee and that it was filed past the period set for filing the motion for reconsideration. "He was given five days but he filed it on the seventh day," he said.

The legal counsel is reportedly filing a motion for execution of the Comelec resolution on Monday.

After the election returns had been counted, Amansec won over Casupang by one vote.

Casupang, however, petitioned at the municipal trial court to recount the ballots but he lost again to Amansec despite having questioned the inclusion of votes to Eping Amansec.

"Eping and Ruben are two different persons. Eping is the father of Ruben," Casupang said in an interview over radio station dzSD.

Due to this, he again petitioned to the Comelec for the resolution of the issue.

The second division of the Comelec ruled that Eping and Ruben are two different persons as Ruben did not list the name of Eping as one of his aliases.

This was upheld by the Commission en banc. FPM
