Defeated Basista mayoral bet dared to file case in court By Fred P. Macaraeg
PANGASINAN provincial election supervisor Reddy Balarbar Wednesday urged the defeated mayoral candidate in Basista town to file an election protest in court and not resort to harassing the municipal election officer.
Balarbar also defended Basista municipal election officer Imelda Lumagui from an accusation by defeated mayoral bet Jesus Perez that the election officer was allegedly biased saying that what the municipal board of canvassers did was just read the election returns submitted to the body.
He pointed out that if there had been any partisanship or election fraud, Perez and other affected parties should have protested right there and then.
"They have watchers, even lawyers, so they should make the complaint right then. Why only now," he said.
Citing that the provincial Comelec office has no jurisdiction over such complaints, Balarbar said the proper venue for the filing of election protest is the court.
And if the problem of the defeated camp was the venue of the canvassing, the contending parties were given notice where the canvassing would be conducted prior to it, he added.
But Perez earlier said they did not receive any notice as to where and when would the canvassing be undertaken. He said they were also not informed as to the composition of the board of canvassers.
He said the municipal election officer did not give him copies of the election returns despite being the municipal chairman of the dominant party in Basista.
Perez accused Lumagui of "very partisan and very bias."
