No more dummies at the market

OCCUPANTS of stalls at the city's public market will lose their right to these stalls if they sub least the area to others without permission from the city government.

This stiff penalty for legitimate occupants of market stalls was specified in Ordinance 2002-91 which amended the 1987 market ordinance.

Specifically, the new ordinance which was enacted by the city council last Wednesday said that "When an occupants whose name appears in the official register as the lessee of a stall in the public markets and its premises is not, in reality, the person who occupies and conducts business in the stall , the privilege to occupy the stall shall be cancelled.

And " if upon investigation, the market lessee is found to have sub-leased his or her stall to another person or to have connived with any person who furnished the stallholder with capital to run his/ her business who is not an alien, said stall shall be deemed to be vacant.

The stall will instead be granted to the dummy or sub-lessee, if qualified.

The ordinance, authored mainly by Councilors Cesar M. Jimenez and Elias S. Enriquez, also provides for a grace period of six months, for the actual occupant to legitimize his business.

Increase of rates for the lease of stalls are also provided in the ordinance.

In an explanatory note, City Councilor Asbi Edding said that "it is an admitted fact that subleasing of stalls and/ or compartments at our public markets in this City is so rampant and widespread to the extent that the majority of those now actually doing business at the market stalls and/ or compartments are no longer the original lessees of the same."

"This ordinance declares all actual occupants doing business at markets stalls or compartments as the legitimate lessees of such stalls or compartments at the public markets in the City of Zamboanga," he said.

Actually this ordinance was long over due already, this was during the time of former City Mayor Vitaliano Agan , Edding Said.

It is for this reason, that after a series of consultation and conference with the City Administrator and the officers of the markets vendors association it was decided that the best way to check the proliferation of these subleasing activities is to declare some sort of amnesty.

This is done by way of declaring all actual occupants and who are presently doing business at said stalls or compartments as legitimate lessees of the of such stalls or compartments and to transfer the rights and privileges of original lessees to such actual occupants presently doing business in such stalls or compartments.

As for the policy, all actual occupants of and doing business at the market stalls or compartments in the public markets stalls are hereby declared as the legitimate occupants and lessees of such market stalls or compartments and for which it is hereby authorized that all rights and privileges of the original lessees be transferred to such actual occupants of market stalls or compartments subject to the conditions and requirements mentioned in the ordinance.
