Council reiterates city's intention on Cabatangan property
THE City Council reiterated Thursday Zamboanga City's unchanged intention to purchase all properties in Cabatangan titled or controlled by the Autonomous Region in Muslim Mindanao (ARMM) based on existing laws.
In similar tone, the City Council also urged the national government to immediately implement article 18, section 1 of Republic Act 9064 otherwise known as the amendatory ARMM law that entitles the city to acquire and own ARMM properties.
The resolutions were co-sponsored by Councilors Juan Climaco Elago and Asbi Edding and approved jointly by all the members present during the session yesterday.
The approval of the measures was based on request of Mayor Celso Lobregat in a letter to the City Council last week. The Council last week deferred action on the mayor's request pending clarification as to what properties are referred to by the mayor in his letter.
The mayor in his letter emphasized that the Council has been consistent and firm in expressing the intention of the city to purchase the Cabatangan property in accordance with the provisions of the law. These intentions, he said, were officially declared in several resolutions approved by the august body as early as 1990.
"Following the city's recent purchase of the privately owned Cabatangan lot from the Wee Sit heirs, a resolution, reiterating the unchanging intent of the city to purchase the property, and urging the national government to implement the provisions of the law is in order," the mayor emphasized.
The city government based on Council Resolution 403, purchased lot 60 in Cabatangan where the Armm executive building is located at a cost of almost P16 million from the Wee Sit heirs.
The mayor, in his letter to the Council furnished a copy of TCT or transfer certificate title (T-184, 702) issued by the office of the City Register of deeds of Zamboanga City in the name of the City Government of Zamboanga, covering 68,509 square meters of Cabatangan property purchased from the private owners.
Also attached in the mayor's letter to the Council was a copy of TCT No. 171, 367 of the office of the Register of deeds, covering the same Cabatangan property in the name of former owners, duly cancelled by the said office in view of the sale of the same to the city.
Councilor Cesar Jimenez revealed that the Cabatangan properties titled and controlled by the Armm covers 43 lots.
