Ex-cop facing slay raps files motion for reconsideration

LAWYER Alfredo Jimenez, chief legal counsel of accused ex-renegade policeman Rizal Alih, recently filed a motion for reconsideration in response to the Supreme Court ruling upholding the city's urgent petition for the transfer of the trial outside of Zamboanga City.

The High Tribunal, in its ruling, granted the city's petition to have Alih's trial heard before the Quezon City Regional Trial Court (RTC).

It directed Regional Trial Court (RTC) Branch 15 Judge Peter Eisma to submit all court records related to Alih's twin murder cases for the death of Brig. General Eduardo Batalla, then regional integrated police-constabulary commander, and his chief-of-staff Col. Romeo Abendan. The two officers were killed when Alih led a band of renegade policemen, mostly his relatives, in the infamous three-day Cawa-Caw siege on January 5, 1989.

After the battle smoke cleared, 14 charred bodies, two were those of the two late constabulary officers, and the 12 others who were Alih's followers were retrieved beyond recognition.

The city's main opposition to the holding of Alih's trial here is anchored on the premise that it will pose serious security risks to the city.

But, Jimenez, in his motion for reconsideration, enumerated several reasons for keeping Alih's in the place where the crime occurred 17 years ago.

Among his reasons is that a trial outside of Zamboanga City will be expensive for his client.

"I even said that I think Zamboanga City is more peaceful than Metro Manila," added Jimenez.

Jimenez said he expects it would take a month at least for the Supreme Court to decide on his motion for consideration.
