Mga opisyales sa Daneco gimadoan nga mohunong sa trabaho

ANG Cooperative Development Authority (CDA) Manila nagmando karon sa mga opisyales sa Davao del Norte Electric Cooperative (Daneco) nga gihatagan og otoridad ilawom sa CDA Certification of Registration nga mohunong sa ilang trabaho.

Ang mando gipaguwa ni CDA chairman Emmanuel M. Santiaguel, penetsahan Septyembre 28, 2012.

Ang kopya sa maong order nga nahuptan sa SuperBalita nagtumbok sa resolusyon sa Court of Appeals, Cagayan de Oro, 22nd Division nga gipaguwa niadtong Agosto 29, 2012.

Gihimong basehan ni Santiaguel ang kaso nga dunay titulong "Gregorio T. Ybanez et.al. vs Hon. Helarion P. Clapis Jr. et.al" nga nakadoket sa CA-GR.SP.No. 04944-MIN.

Ang dispositive portion sa maong resolution nagkanayon: "Accordingly, the application for a Writ of Preliminary Injunction be issued, effective immediately and during the pendency of the present action and/or until otherwise ordered by this Court, prohibiting and enjoining the public respondent and its deputies/agents and all persons acting in its behalf and/or instructions from implementing the Order of the RTC Nabunturan dated May 23, 2012, issued in SP Civil Case No. 108, which granted private respondents' prayer for Writ of Preliminary Injunction. Consequently, private respondents are prohibited and enjoined from further exercising powers as members of the Board of Director, or as responsible officers of Daneco."

Ang WPI unang gipatuman sa court Sheriff niadtong Oktubre 3 sulod sa Daneco Tipaz, Barangay East, Tagum City.

"Accordingly, all persons acting by virtue of the issued Certificat of Registration are hereby directed to cease and desist from further performing and exercising their powers and functions," suma sa maong order.

"This order shall take effect during immediately upon receipt hereof and shall continue to have force and effect during the pendency of the investigation otherwise lifted by the Authority," dugang niini.

Ang order sa CDA nahuptan sa SuperBalita niadtong Sabado human nasamok ang pagpatuman sa WPI nga gitunol ni Renato Suarez, Sheriff IV sa Regional Trial Court Branch 3, Nabunturan, Comval aron pahunungon sa trabaho ang kasamtangang board of directors lakip na si Daneco OIC General Manager Reynaldo Bandala.

Wa mituo ang mga hintungdan tungod kay, suma nila, photocopy lamang ug way pirma sa Associate Justices sa Court of Appeals.

Apan tungod sa kagubot nga nahitabo, nagpadala na ang CA sa ilang resolution nga gipirmahan nila Associate Justices Marilyn B. Lagura-Yap, Edgrado A. Camello ug Renato C. Francisco.

Tungod sa nahitabo, giamendahan sa mga justices ang una nilang WPI.

Sa maong amendment, gibutyag niini: "This necessarily includes private respondents' agents and representatives, including Mr. Rey Bandala, and all persons taking orders from him and/or acting from and in his behalf."

Gimandoan sab ang sheriff nga ipatuman gayud kini pinaagi sa tabang sa kapulisan sa labing daling panahon.

"Wala pa ko kabalo kung naay order gikan sa CDA kay sukad nga migawas ang preliminary injunction, wala na ko mi-report sa Daneco. Amo nalang ning isalig sa among abogado," suti ni Dean Briz, kanhi presidente sa Daneco, dihang gitawgan sa SuperBalita kagahapon. (Alger P. Dura)
