DILG refuses to recognize mayor-A A +A

THE Department of the Interior and Local Government (DILG) in Eastern Visayas has refused to recognize the sitting mayor of Calbiga town in Samar.
DILG Regional Director Pedro Noval Jr. said they have to wait for the decision of the Commission on Elections (Comelec) en banc on the petition for annulment of declaration of Nicasio Abaigar as winner in the May 13, 2013 elections.
“We cannot recognize Abaigar as mayor. But as to his qualification, Comelec en banc decided he cannot run. The decision was supposed to be implemented, but he (Abaigar) filed a petition for certiorari, which was dismissed by the Supreme Court,” Noval said.
“We are waiting for the petition for annulment of proclamation, which was not yet decided upon by the Comelec en banc,” Noval added.
Comelec cancelled Abaigar’s certificate of candidacy (COC) for mayor of Calbiga because he was not a Filipino citizen at the time of his filing.
The Comelec en banc denied Abaigar’s motion for reconsideration for lack of merit.
Losing candidate Melchor Nacario filed a petition at the Comelec to annul the proclamation of Abaigar as mayor-elect of Calbiga.
To recall, Abaigar’s name remained on the ballot on Election Day and was proclaimed as the winner.
Nacario said that Abaigar was no longer a candidate at the time of the election, with the Comelec en banc having denied with finality his motion seeking reconsideration of the cancellation of his COC.
“It’s up to Comelec to decide, but until now, we still refuse to recognize Abaigar as mayor,” Noval said.
When asked about the financial transactions involving the municipality, Noval said it is up to the bank to recognize Abaigar in all its undertakings.
“The bank has to decide whether the municipality can use their funds and honor the checks signed by Abaigar,” Noval said.
As of Wednesday, Abaigar has not yet issued his official statement regarding his status and the refusal of the DILG to recognize him as mayor. (Leyte Samar Daily Express)
