5 Davao prisoners released via enhanced justice on wheels

THE Regional Trial Court (RTC) Branch 16 ordered the release of five prisoners whose cases had been dismissed or temporarily dismissed in line with the enhanced justice on wheels (Ejow) that was conducted in all Davao courts on Friday, October 28.

The five were part of the 13 inmates whose cases were dismissed, temporary dismissed, and were approved for plea bargaining for lower offense by RTC 16 presiding judge Emmanuel Carpio.

The case ordered temporarily dismissed was the murder case filed against Jose Cavan Becerra alias Jojo Putot, an alleged gun-for-hire that was tagged in the vigilante killings in 2010.

Becerra was included among the top of the criminal list of Davao Police office with seven criminal charges-four cases of murder, one for illegal possession of firearm and another for violating the Commission on Election-imposed gun ban during the 2010 synchronized barangay and Youth Council elections.

Bacerra was previously tagged in the series of Davao Death Squad-penetrated murders after a caliber .45 pistol seized from Bacerra was linked to at least 10 summary killings.

He was arrested by the Southern Mindanao Criminal Investigation and Detection Group-General Santos City last July 2015 after 10 warrants of arrest were served against him.

The clerk of RTC 16 said the grounds of temporary dismissal for the case is the non-appearance of the complainant during scheduled trials when the accused also requested for this right for speedy trial.

A temporary dismissal means that within two years the case can still be revived, and that it will only be dismissed after two years.

Also among the cases included was the rape case filed against Nordin Tidlawan whose case was dismissed for the grounds of lack of sufficient evidence.

Another estafa case was also acquitted where the accused was asked to pay for civil liabilities worth of P800,000. (KVC)
