Security guard faces murder rap

THE Office of the Cebu City Prosecutor indicted a security guard who shot dead a laborer and wounded another in Barangay Tejero last Dec. 22.

Prosecutor Maria Liza Miscala-Jorda found evidence to charge Bienvenido Macaraeg with murder before the Regional Trial Court in Cebu City.

Macaraeg, 38, a security guard of the Pioneer Detective Security Agency, killed Raul Simbajon, 49, and wounded Gerson Tumulak, 37.

Murder is a non-bailable offense.

Macaraeg, a resident of Nivel Hills in Barangay Apas, was assigned in Gothong Southern.

Police said that Simbajon and Tumulak, both laborers of a hardware store, were on their way home from attending a Christmas party when Macaraeg accosted them.

Macaraeg, who was drinking liquor with a friend, followed the victims after Simbajon reportedly glared at him “maliciously.”

Macaraeg and Simbajon argued, which resulted in the guard pulling out his gun and shooting the victims.

The two men were shot several times, but they still managed to hail a taxi and go to the Cebu City Medical Center (CCMC).

Simbajon, who was shot in the chest, was pronounced dead on arrival. Tumulak, who was shot in the back, survived.

Four days after the shooting, Macaraeg surrendered to Vice Mayor Edgardo Labella.

Macaraeg told Abella that he shot the two to defend himself after the victims allegedly drew out a gun to shoot him.

In the charge sheet, Prosecutor Jorda said the elements of murder are present in the case since “treachery and evident premeditation” exist in the fatal shooting.
