Alleged pusher faces charges

AN ALLEGED notorious drug pusher is facing charges before the court after he was arrested by the Sasa police and the Criminal Investigation and Detection Group (CIDG) 11 in a drug-bust operation conducted at Hacienda Heights in Sasa on January 17.

Charged with violation of the Comprehensive Dangerous Drugs Act of 2002, is Edwin Flores Pelaez, alias Bossing, a resident of Doña Pilar Village in Sasa, Davao City.

Prosecutor Daniel Fernandez found probable cause to charge the accused based on the complaint filed by the Sasa police station and CIDG-Davao.

According to the resolution dated January 23, an evidence showed that the accused sold one sachet of suspected shabu worth P2,000 to the poseur buyer.

When the accused was frisked by cops, they allegedly recovered another sachet of suspected shabu and a P2,000 marked money.

Attached to the complaint-affidavit is the chemistry report of the Police Regional Crime Laboratory Office (PRCL) 11 which stated that the evidence submitted was positive with methamphetamine hydrochloride.

Fernandez also stated in the resolution that the urine sample taken from the accused also tested positive for methamphetamine hydrochloride.

"It is justified as the accused was caught in the act of selling shabu which is punishable under section 5 (distribution of dangerous drugs) and section 11 of the RA 9165," Fernandez said.

Fernandez also said that the seizure of the additional sachet of shabu is also valid as this was confiscated pursuant to a search incidental to a lawful arrest.
