THE Davao City Council is set to pass on third and final reading Tuesday, January 31, an ordinance requiring all telecommunication companies and Davao Light and Power Company to comply with underground cabling plan that will cover CM Recto St., Magsaysay Avenue and Quirino St.
Based on the copy of the proposed ordinance, this ordinance covers the implementation of first phase with estimated length of 1100 meters of C.M Recto Street within the year 2017.
The project will start in the junction of San Pedro Street, and will end at the junction of R. Magsaysay Avenue.
The second phase of the project within the construction period of 2018 covers more or less 1400 meters of San Pedro Street, and it will start at corner C.M Recto and will end at Quirino Avenue.
Included in the second phase is the 14000 meters more or less underground cabling covering Magsaysay Avenue and will start in C.M Recto.
The phase three will cover street between Roxas Rotunda and San Pedro Street.
And the last phase with target completion in 2020 will cover E. Quirino St. starting from San Pedro Street, and will end at Boy Scout of the Philippines-Quirino.
The main objective of the project is for Davao City to be internationally competitive, capable of attracting investments, to provide the clear model of sustainable and aesthetic demands on the aesthetic response to the rising demands of progress and their impact to the environment.
The Section 5 of the ordinance mandates all electric utility companies and public telecommunication carriers servicing the city, including but not limited to other persons constructing, maintaining, installing aerial wires and cables shall place all the wires and cables underground.
Section 6 states a fine of P5,000 will be enforced to those who violates the ordinance, after three notices are issued. The violators may suffer cancellation of business permit if they still fail to follow the ordinance after fourth and fifth notice.
If the violation is committed by partnership, corporation, association, firm or other judicial entity including government owned or controlled corporation, the penalty shall be imposed on the president, general manager and each of the officers of these entities.
In addition, the penalty shall also include the cancellation of business license. The cost of the underground cabling project including the restoration of the excavated streets are shall be jointly shared among the electric utility companies and public telecommunication carriers as determined in the integrated design or plan as formulated by the Wires and Cables Technical Team.
