Agreement with Mega Harbour can be revised

THE joint venture agreement (JVA) for the multi-billion peso Mega Harbour project can still be revised, a legislator said.

Majority Floor Leader Bernard Al-ag, in a media interview, said a review and amendments can still be done since Davao City Mayor Inday Sara Duterte-Carpio will be the one to give the final notice for the project to proceed.

Al-ag said case amendments will be presented in the review and approved by the two parties, same amendment will be approved through a normal legislative process.

"It is still possible and amendment is possible kasi wala pang notice to proceed so ang pwedeng gawin ni Mayor Sara is to hold the notice to proceed kung may gusto silang ipa-validate," he said.

Al-ag added that to veto the project, which the mayor earlier vetoed but subsequently denied, is not possible because the JVA is already approved and signed by former Davao City Mayor Rodrigo Duterte with the developers of the project.

"The ordinance was already signed, so the approval is now at the national level, under Philippine Reclamation Authority, so once it will be approved there, and also in National Economic and Development Authority, they have to go back to the City Mayor's Office, not to the SP, to request for a notice to proceed," he said.

Al-ag added that during the time of the developer's request for the final notice, the agreement can still be re-drafted if the mayor wants to improve the position of the JVA, and wants to put additional positions.

He said parties of the JVA shall jointly write a letter to the City Council to change the provisions as agreed by the two parties involved in the agreement.

"Hindi pwedeng isa lang eh, it has to be a joint agreement between the two," Al-ag said.

Al-ag said that once it will be finalized and a letter is sent, it will go to the same process including public hearings.
