Marvil: Sufficient ground for Uniwide contract cancellation

AFTER constantly ignoring the invitation of the city council to appear before them to shed light on the issue on whether they are still qualified, willing and interested, as well as capable to implement the contract to develop the City Public Market, Committee on Laws chairman Councilor Faustino Olowan said that they now have sufficient grounds to cancel or rescind the contract between the city and Uniwide Sales Realty Corporation.

The city council earlier filed a resolution respectfully inquiring from the Honorable Executive Judge, Parañaque City Regional Trial Courts on the status of all pending cases relative to the Uniwide Sales Incorporated, the Uniwide Holdings, Incorporated, The Naic Resources and Development Corporation, Uniwide Sales Realty and Resources Corporation, and the First Paragon Corporation and Warehouse Club, Incorporated in which the Office of the Clerk of Court of the said RTC responded by forwarding the documents to the city council and was received yesterday.

The said document contains the list of cases with corresponding civil case numbers, titles and the branches where the same were assigned by raffle for the duration of the year 1996 up to January of this year.

Olowan stated that the said documents are proof that the company is already bankrupt and that there is a pending case on the courts for payment or distribution of Uniwide’s assets to its creditors.

The council chairman on Laws likewise indicated that the council can now file a case in the RTC of Parañaque declaring that Uniwide cannot continue with the contract due to bankruptcy so that the said court can issue an order cancelling the contract.

Olowan further said that the documents obtained from the Parañaque RTC can also be used as basis for unilateral rescission since it is a confirmation that Uniwide can no longer perform as a corporation thus they cannot get any projects and cannot enter into a contract.
