A 15-YEAR-OLD boy is facing attempted murder charges after he was arrested last Wednesday, February 1, on accusation of trying to kill a policeman at Times Beach in 76-A village in Davao City.
In a resolution dated February 8, prosecutor Imee Bisera-Mabale found probable cause to charge the accused based on the affidavit-complaint filed by Police Officer 1 Daniel A.P. Garcia of Compostela Valley Provincial Public Safety Company.
Garcia said he was at the house of his father-in-law at Times Beach when he went out at around 2:41 a.m. to urinate and chanced upon seven males, four carrying knives while the rest carrying bottles.
The complainant asked the group where they were going but one of the three males carrying empty bottles approached and attempted to hit him, the others followed suit and tried to attack him.
Garcia drew his gun, told the group that he was a policemen, but the boys picked up stones and pelted him as well as threw the empty bottles at him.
One of the boys even shot him with an improvised dart (Indian pana). He missed. Garcia was able to grab hold of the accused while the rest ran away.
Attached to the complaint is the Social Case Study Report (SCSR) from Ariel Aguilar, a social worker of the Davao City Social Services Development Office, stating among others that the accused Era acted with discernment.
Bisera-Mabale said the six other suspects whom Garcia accused to have intended to kill him will also be subjected to a regular preliminary investigation but tasked Garcia to provide their addresses.
The prosecutor finds the arrest of the accused legal as he was caught in flagrante delicto committing an offense. (ICT)
