Homicide vs man for brother's death

THE homicide case against a man who stabbed his brother to death last December 13, 2014 was raffled off to the Regional Trial Court Branch 16.

Based on the list of raffled cases from the RTC Office of the Clerk of Court, the case against Ernesto Ubsuban Boticario Jr. of Barangay Malabog in Paquibato District will be tried before the sala of RTC Branch 16 Judge Emmanuel Carpio.

It was reported that Prosecutor Gaye T. Cañete found probable cause to charge Boticario based on the complaint filed by Police Officer 3 Luther Napoles and the statement of Police Officer 1 Fernand Andan.

Based on the affidavit, the respondent voluntarily surrendered himself to the Malabog Police Station for having killed his brother, Jover Boticario.

The night before the incident, Ernesto and his father were reportedly having a drinking session with one Romel Moquino Piguras when Jover, who was already drunk at that time, threatened the respondent that he will kill him. Piguras then told Ernesto to leave Jover alone and sleep in their house.

The next day, Jover went to Piguras' house threatening Ernesto once again which led him to stab the respondent, resulting to his death.(KGL)
