Bureau of Internal Revenue files raps vs 2 firms

CITY OF SAN FERNANDO -- The Bureau of Internal Revenue (BIR) Region 4 has filed charges against two firms, a cement factory and a food products company, for violating the revenue and tax laws.

The bureau filed criminal complaint against Tiongco High-Tech Construction Materials Corporation (High-Tech Corp) and its President Alicia Tumanda before San Fernando City Prosecutor’s Office for unlawful pursuit of business punishable under Section 258 of the National Revenue Code of 1997.

High-Tech Corp. is a corporation duly registered with the Securities and Exchange Commission and is operating at Talayan Village, Quezon City.

The company is engaged in the sale and manufacturing of construction materials, particularly cement products.

The case stemmed from third party information received by the Revenue District 21B-South Pampanga concerning the business activities of High-Tech Corp., which prompted the said district to verify the information.

Upon verification, High-Tech Corp. has been found to have violated Section 258 of the Tax Code of 1997, as amended by carrying out a branch office engaged in manufacturing of cement in Barangay San Jose Gumi, Lubao, Pampanga without prior registration with BIR 21B-South Pampanga and payment of the required registration fee.

Verification from Lubao Municipal Government revealed that the said branch started business in January 2015 with a declared total gross receipts of P5,000,000.

The BIR Region 4 also filed a criminal complaint the other day against Bounty Fresh Food Inc. and its president Tennyson Chen for unlawful pursuit of business.

The case was filed before the Tarlac Provincial Prosecutor’s Office.

Bounty Fresh is a stock company duly registered with the Securities and Exchange Commission, which operates at 179 Mariano Ponce St., Caloocan City. It holds out itself, together with its sister company, Bounty Agro Ventures Inc. as a supplier of chicken products.

The criminal complaint stemmed from the Tax Compliance Verification Drive and Tax Mapping activities conducted by the Revenue District Office No. 17 Paniqui, Tarlac on March 10, 2017.

The BIR said that Bounty Fresh has been found to have violated Section 258 of the Tax Code by carrying out a branch office engaged in hatchery business in Pada-Pada, Gerona, Tarlac without prior registration and payment of the required registration fee.

Verification from Tarlac Municipal Government revealed that the said branch started its business in 2013, with a total declared sales of P169,318,595.80 for four consecutive years.

The criminal case is the 6th case filed by BIR Revenue Region 4 under the local Run After Tax Evaders Program of the BIR for 2017.
