Security guard sued for murder

A SECURITY guard is facing charges before the court after he shot and killed a neighbor at Purok 20, Barangay Upper Sirib, Calinan District in Davao City last month.

Rene Dominisac Gaccion, a resident of the same district, was charged with murder for killing his neighbor Armand Cuizon.

Prosecutor Daniel Fernandez found probable cause to charge the accused based on a complaint filed by the brother of the victim, Arnel Cloribel Cuizon.

In a three-page resolution dated September 13, a witness alias “Basoy” attested that the incident happened at around 8:30 p.m. on August 27 outside the San Agustin Chapel at Purok 20.

Basoy said a mass was held wherein a number of people were praying inside the chapel when the son of the accused identified as Dodong, who was then fixing his motorcycle, suddenly accelerated its engine, causing disturbance in the area.

Armand reprimanded Dodong and asked the latter to refrain from accelerating the engine of his motorcycle because there was an ongoing mass, but Dodong arrogantly responded to him.

The accused then interfered and without apparent reason hurled punches to the victim that led to a fistfight.

A few minutes after, Armand decided to stop the fight and turned away from the accused.

But Dodong pulled a pistol from his waist and shot Armand at close range, hitting the latter at the lower portion of his back.

Basoy said a certain Allan Erosido, of the Philippine Army, pacified the situation and recovered the caliber .9mm pistol from the accused, which was registered under the name of the Mongoose Security Agency.

Arnel and Basoy witnessed that the victim died while being treated at the Southern Philippines Medical Center on August 28.

The accused surrendered to the police authorities on August 30 and is currently detained at the Calinan Police Station.
