Poll official ‘doubts’ 2019 polls can be moved

The 2019 national mid-term elections can only be postponed if a new Constitution is passed and approved by Congress.

Or, if incidents like violence, terrorism, loss or destruction of election paraphernalia or records, force majeure or other causes prevent the holding of a free, orderly and honest election, according to the Omnibus Election Code, or Batas Pambansa 881 Atty. Ferdinand Gujilde, Cebu Provincial Election Officer, said that only the Commission on Elections en banc has the authority to postpone elections.

Some legislators want next year’s elections moved in preparation for a possible transition to a federal form of government.

But Gujilde said that Congress must first initiate the passage of a new Constitution.

This can only done through a constituent assembly, a constitutional convention or a people’s initiative.

But with election season drawing near, he doubts the elections will be postponed.

The filing of certificates of candidacy will be in October, while the registration of new voters is ongoing and will end in September. (JKV)
