Subpoena vs mall fire personalities released

A PROSECUTOR said the subpoena against the 33 individuals who could possibly be held liable for the fatal NCCC Mall fire in December 2017 has been released.

Senior Assistant Regional Prosecutor lawyer Robert Michael Razon told SunStar Davao that the Office of the City Prosecutor in Davao issued on September 6 the subpoena against the individuals listed by the Inter-Agency Anti-Arson Task Force (IATF) who could be charged for the blaze.

A total of 38 persons, mostly employees of a call center that was leasing space within the mall, perished in the fire.

“We will wait for the submission of the counter-affidavit po. They are given 10 days from receipt of the subpoena to submit (their counter-affidavit),” Razon said.

Personalities who are facing criminal charges for reckless imprudence resulting in multiple homicide and multiple physical injuries are the mall owners, SSI management, BFP officials, contractors, and building officials.

Their counter-affidavit will only be considered if it is submitted on or before the deadline.

“The investigating prosecutor will resolve based on the complaint-affidavit only,” Razon said.

Razon earlier said they will do their best to finish the case proceedings before the anniversary of the incident on December 23 amid the complexity of the case which would take months to finish.
