SPOUSES ROQUE & FATIMA TING VS. CITY OF CEBU

Cases: Collection of sum of money & petition for review on certiorari

Background: Spouses Roque and Fatima Ting sued the City for damages. Roque presented titles for two lots totaling 4,222 square meters that are now part of the SRP. The Regional Trial Court ruled in favor of Ting in 2008. But then Vice Mayor Michael Rama convinced Mayor Tomas Osmeña that the City need not pay the couple because the property was under water. The amount has since ballooned to P57 million.

Amount involved: P57 million

ROMULO TORRES VS. CEBU CITY COUNCIL

Case: Civil petition for declaratory relief and injunction with temporary restraining order (2015)

Background: Taxpayer from Barangay Basak San Nicolas sued the City over the 45.2-hectare lot at the SRP. He wanted the court to stop the council from appropriating funds from the P8.3 billion down payment the City received from three developers that won the bidding for the SRP lots.

PEOPLE OF THE PHILIPPINES VS. IMELDA LIM

Case: Violation of the revised penal code; for other deceits (2016)

Background: Cebu City Mayor Tomas Osmeña filed criminal charges against four officials of the SM Prime Holdings Inc. for allegedly misrepresenting the size of its building to reduce its tax obligations to the City Government. Respondents: Hans T. Sy Jr., (chairman of the board), Jose Cuisa Jr. (vice chair of the board), Hans Sy (executive director) and Imelda Lim (senior tax manager). Osmeña claimed that SM only paid P14 million in tax when it should have been P37 million.

Amount involved: P23 million

APAS BARANGAY CAPTAIN VS. TOMAS R. OSMEÑA, CITY TREASURER TESSIE CAMARILLO

Case: Violation of the Anti-Graft and Corrupt Practices Act: grave misconduct, conduct prejudicial to the best interest of the service and conduct unbecoming of a government employee (2017)

Background: In 2014, the City Council passed a resolution authorizing former mayor Michael Rama to negotiate and dispose by sale through public bidding to any interested and qualified parties some 26 hectares of lots at the SRP. When Osmeña won as mayor, he ordered Tessie Camarillo to refrain from accepting the installment payments from the buyers. “He has a sacred duty to enforce all laws and ordinances relative to the governance of the City and accordingly ensure that legal and contractual obligations of the City are honored and complied with,” Ayuman said. The village chief called the act an “economic sabotage.”

JOEL GARGANERA VS. TOMAS R. OSMEÑA, CEBU CITY COUNCIL, CIPC, REGISTER OF DEEDS

Case: Prohibition with application for the issuance of a restraining order and a writ of preliminar injunction (2017)

Background: Councilor Joel Garganera asked the court to prohibit the City from leasing the SRP.

SM PRIME HOLDINGS INC. SHOPPING CENTER MANAGEMENT CORP., SM LIFESTYLE ENTERTAINMENT INC. VS. CEBU CITY, TOMAS R. OSMEÑA, ENGR. JOSEFA YLANAN

Case: Writ of mandamus and prohibition with application for an ex-parte 72-hour restraining order and write of preliminary injunction

Background: SM filed the case to compel the City to renew its business permits and those of the mall's tenants.

AYALA LAND INC., CEBU HOLDINGS INC. & SM PRIME HOLDINGS INC. VS. CITY OF CEBU

Case: Consignation (2018)

Background: The consortium of Ayala Land Inc., Cebu Holdings Inc. and SM Prime Holdings Inc. purchased a property at the SRP during the time of former Mayor Michael Rama. The case intends to force Mayor Tomas Osmeña to accept the payment of the consortium.
