GIKLARO ni Presidente Rodrigo Duterte niadtong Martes, Nobiyembre 6, nga ang iya rang gusto mao ang “presensya” sa military sa Bureau of Customs (BoC) sa paninguha nga mahunong na ang mga kahiwian sud sa mao nga buhatan.
Ang pamahayag sa Presidente nagbakwi sa iyang pahibawo sa miaging semana nga gusto siya og “military takeover” sa BOC.
Si Duterte, atol sa lecture sa militarization ug drugs, nitataw nga wa siya motudlo og mga sakop sa Armed Forces of the Philippines (AFP) ngadto sa sibilyan nga mga posisyon.
“Now ngayon, sabi nila na (they said that it) it violates the Constitution and the operative word there [is] the prohibition of appointment or designation,” matod sa Presidente.
“When I called in the Army to help the Bureau of Customs, there was no designation, there was no appointment and there was never an instruction for them to take over the functions of the employee,” siya nidugang.
Niadtong Oktubre 28, si Duterte niingon nga siya “napugos” sa dinaliang lakang sa pagtugot sa militar sa pagpadagan sa BOC, kay nagpadayon ang “dirty games” sa bureau.
Ang giduso nga pagpuli sa militar nakaani og grabeng pagsupak sa mga kritiko ni Duterte.
Ang Section 3, Article 2 sa 1987 Constitution naglatid nga “civilian authority is, at all times, supreme over the military.”
Ang Section 5(4), Article 16 sa Constitution nagkanayon usab nga “no member of the armed forces in the active service shall, at any time, be appointed or designated in any capacity to a civilian position in the government, including government-owned or -controlled corporations or any subsidiaries.” SunStar Philippines
