GIPIRMAHAN ni Presidente Rodrigo Duterte niadtong Pebrero 14 ang Republic Act (RA) No. 11213, ang Tax Amnesty Act of 2019, nga naghatag og amnesty sa mga tawo nga napakyas sa pagbayad sa saktong buhis sa tuig 2017 ug paubos.
Ubos niini, ang gobyerno mokolekta lang og 6 porsento sa wa madeklarar nga estate tax alang niadtong namatay sa wa pa moabot ang Enero 1, 2018. Mas ubos ang buhis nga bayran niadtong dunay tax delinquencies nga wa maapil sa miaging mga tax amnesties.
Apan gi-veto sa Presidente ang probisyon niini alang sa general tax amnesty tungod sa kapakyas sa balaod sa paglibkas sa bank secrecy for tax purposes. Ang Pilipinas ug Lebanon ang nahabiling mga nasud nga adunay istrikto nga bank secrecy law.
Di kini ang bugtong higayon nga gigamit sa Presidente ang iyang veto power ubos sa 1987 Constitution. Gi-veto usab sa Presidente ang coco levy fund bill ug ang laing balaudnon nga magpalig-on unta sa Philippine Coconut Authority (PCA) board.
Ang veto power sa Presidente apil sa sistema sa checks and balances sa atong Batakang Balaod. Tinuod nga ang Kongreso mao ang tigpanday sa balaod. Apan kon di makauyon ang Presidente, mahimo nga iyang i-veto ang usa ka balaudnon.
Ang Article VI, Section 27 (1), 1987 Constitution, nagkanayon, “Every bill passed by the Congress shall, before it becomes a law, be presented to the President. If he approves the same, he shall sign it; otherwise, he shall veto it and return the same with his objections to the House where it originated, which shall enter the objections at large in its Journal and proceed to reconsider it.”
Ang Kongreso mahimo sab mga mo-override sa veto sa Presidente pinaagi sa two-thirds vote sa mga sakop niini. Ang maong probisyon nagkanayon, “If, after such reconsideration, two-thirds of all the Members of such House shall agree to pass the bill, it shall be sent, together with the objections, to the other House by which it shall likewise be reconsidered, and if approved by two-thirds of all the Members of that House, it shall become a law. In all such cases, the votes of each House shall be determined by yeas or nays, and the names of the Members voting for or against shall be entered in its Journal.”
Ang Presidente kinahanglan nga mopahibalo sa iyang veto sud sa 30 ka adlaw gikan sa pagkadawat sa balaudnon. Kay kon di, mahimo kining balaod sama da nga iya kining gipirmahan.
