They only recommend

The owner and three employees of the piggery in Sangat, San Fernando, Cebu are free, out on bail. Not surprising because crimes against environment laws are bailable offenses.

But the piggery is reportedly still operating (as of Monday, March 11), and, if the NBI finding is correct, apparently continuing to spew out waste of thousands of hogs into the seawaters.

It seems that local regulators can only recommend closure of the facility. And the last news from them is that they still have to test the seawaters in surrounding areas, not just the spot where pipes that funnel the waste, which has earned the sitio the name "Baho" (with circumflex on the "o").

One supposes that the piggery, which has managed to get away with what it has been doing for almost 50 years, can survive another decade or more.

And the community that has gone through all those years of the stink from the foul odor and lived would just be "all right and okay."

Lot donation 'not valid'

The police may be taking the meaning of "police power" literally.

It insists, through regional chief Debold Sinas, on its "right" to use the lot donated to it by the former barangay captain of Inayawan, Cebu. After the fence walling off the lot was torn down by the present barangay chief, PNP built another fence, a dyAB news report said, this time with a stern notice posted at the premises that destroying it or intruding into the property would risk of arrest and prosecution.

The problem is that the lot donation to the PNP may be questionable and invalid because it was not approved by the barangay council.

Earlier, the new barangay captain had opposed the use of the lot and offered another lot nearby because it would occupy part of the road and obstruct traffic.

"Police power" to the cops means just that, flexing its muscle of authority. The meaning of the phrase is different under the Supreme Court definition.
