Public buses cannot be registered without certificate of no pending case: RTWPB

THE Regional Tripartite Wages and Productivity Board (RTWPB) has announced that the Land Transportation Office (LTO) should not allow a public utility bus (PUB) to be registered if the owner cannot submit a “certificate of no pending case” filed by drivers and conductors and issued by the Department of Labor and Employment (Dole).

RTWPB 7 Secretary Grace Carreon said the certificate must also bear the confirmation of the Land Transportation Franchising and Regulatory Board (LTFRB).

LTO is a government agency charged with registering all vehicles, while LTFRB is authorized to issue a franchise to all public utility vehicles, including passenger buses.

Carreon said the new guidelines ensure that PUB owners and operators provide the right compensation to drivers and conductors set by the National Wages and Productivity Council (NWPC).

She told SunStar Cebu that in 2012, Dole issued Department Order (DO) 118-12, which came up with a “part-fixed, part performance-based” compensation scheme for drivers and conductors.

The NWPC, the mother agency of RTWPB, issued guidelines to implement the compensation component of DO 118-12.

Last February, NWPC revised the old operational guidelines, which took effect last March 9.

“PUB owners and operators will have to resubmit another compensation scheme of which part is fixed compensation based on the existing minimum wage and part is performance like overtime, 13th-month pay and incentives,” the NWPC said.

The elimination of purely performance-based compensation should discourage drivers from racing to the next stop to be the first to load new passengers and lingering in pickup areas, Dole Secretary Siwlvestre Bello III had said. (EOB)
