City Triangle eyes legal action vs developer

THE management of the City Triangle Commercial Center is looking into the possibility of taking legal action against Euro Towers, developer of the Vivaldi Residences, following the damages caused by the construction of the condominium.

City Triangle property leasing officer Alfredo Pontillo said he will be discussing it to the board of the Boy Scouts of the Philippines, the one who acquired the City Triangle in 2014, for possible legal actions.

Pontillo added he will file another formal complaint at the City Engineer’s Office.

However, he said they are still open for a settlement as long as Euro Towers takes action to their complaint.

On Thursday, April 11, Pontillo said Euro Towers is not taking any action on the falling debris that land on the retail center.

Pontillo added that this has been going on since December 2018.

He said the operation of the retail center has been affected since Vivaldi started its construction, affecting its tenants who are complaining for disrupted power supply, flooding in times of rain due to the hole at the rooftops caused by the fallen debris, and acrid smell in comfort rooms due to the dislocated septic tank because of Vivaldi's excavation activity.

Euro Towers, in a statement to SunStar Davao on Saturday, April 13, said the City Triangle did not mention in their talks any damage caused by their construction.

The real estate developer said the supposed debris are Phenolic boards placed on the City Triangle's rooftop to augment the safety nets they placed on the sides of their edifice, claiming they are in fact going beyond the required protection standards.

“This was the safety measure agreed between the respective managements of Vivaldi Residences Davao and City Triangle,” Euro Tower said in a statement.

The real estate company also said Pontillo's claimed damage to their power transformer is not caused by their ongoing construction.

“Our construction is inspected and verified by our construction team,” Vivaldi said.

Euro Towers said it is in constant communication and coordination with the management of the City Triangle Commercial Center.

The company said its management ensures the protection and integrity of the City Triangle.

Meanwhile, Pontillo said the personnel from the Davao Light and Power Co. and the City Engineer’s Office confirmed in its previous inspection that the power interruption was triggered due to the falling debris from the ongoing construction.

Pontillo added he was not satisfied with Euro Tower’s statement.

“Didtoa ra sila nag-focus sa electrical aspect. Wala nila gitubag ning among reklamo nga tungod sa fallen debris nga nangatagak sa among atop, hinay-hinay nag kaapektado amoang negosyo (They focused on the electrical issues but they have not given an answer on our complaints that their falling debris is already affecting out business),” he said.
