Dole to employers: Pay those who work on May 13

THE Department of Labor and Employment (Dole) said workers who will be reporting to work after casting their votes on Monday, May 13, should be paid the corresponding rate on that day.

Dole 7 Director Salome Siaton said May 13, election day, is a special non-working holiday, and employers are reminded to take note of the computation of wages.

Siaton said Labor Advisory No. 07, Series of 2019, indicates the following rules for pay on May 13:

First, if the employee did not work, the “no work, no pay” principle shall apply, unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment on a special day;

Second, for work done during a special holiday, the worker shall be paid an additional 30 percent of his or her basic wage on the first eight hours of work;

Third, for work done in excess of eight hours or overtime work, the worker shall be paid an additional 30 percent of his or her hourly rate on said day;

Fourth, for work done during a special holiday that also falls on the worker’s rest day, he or she shall be paid an additional 50 percent of his or her basic wage on the first eight hours of work; and

Fifth, for work done in excess of eight hours or overtime work during a special holiday, that also falls on the worker’s rest day, he or she shall be paid an additional 30 percent of his or her hourly rate on said day.

Dole 7 Labor Information Officer Luchel Senarlo-Taniza said the issuance of the labor advisory is pursuant to Proclamation No. 719 issued and signed by President Rodrigo Duterte last May 9, 2019. (EOB)
