FOUR other senior high school students are facing complaints for rape, acts of lasciviousness and violation of Republic Act 9995 or the Anti-Photo and Video Voyeurism Act for allegedly raping a 16-year-old girl and uploading the video of the alleged rape online.
The Women and Children Protection Desk and Investigation and Detective Management Branch of the Cebu City Police Office filed the rape and acts of lasciviousness complaints against the four senior high school students.
Only two of them are facing a complaint for violation of Republic Act 9995 or the Anti-Photo and Video Voyeurism Act before the Cebu City Prosecutor’s Office.
The complaints were filed on Tuesday, Oct. 8, 2019, following the confession of Elmer (real name withheld) that he raped the victim and his testimony on the role of his friends in the incident.
Elmer had surrendered to the police on Sept. 21 and issued a sworn statement detailing the incident. A rape complaint was filed against him on Sept. 23.
In her affidavit, Amanda (not her real name), a Grade 11 student from Consolacion, said that at around 4 p.m. on Thursday, Sept 5, 2019, she and her friends went out for a drink after their class.
She felt dizzy after she had several bottles of beer and some hard drinks.
The next thing she knew, she was already kissing one of the boys in the group during the drinking session.
Amanda recalled that she got dizzier after they had a few more rounds of drinks.
A couple of hours later, she noticed that her male classmate was already touching her face and she was already naked inside an unfamiliar place.
The victim stated in her affidavit that she was brought to a lodge and when she woke up, her male classmate was also naked and was already on top of her.
“I don’t know where that lodge was because I was so drunk. I was lying in bed and Elmer was already on top of me. He inserted his penis inside my vagina even if I said no. I was unable to resist because I was dizzy when it happened,” her sworn statement read.
After the incident, Elmer reportedly called their female classmate past 11 p.m. on Sept. 5 to ask her to pick up Amanda, but she did not take the call.
Amanda said she decided to spend the night at Elmer’s house.
She said she could not recall what happened after she blacked out and was shocked that a sex video of her went viral on social media.
In his own sworn statement, Elmer identified another male friend, a student in another private university, as the one who had kissed Amanda and asked her to perform oral sex on him inside a vehicle.
Another senior high school student took the video of Elmer removing Amanda’s bra and touching her breasts. The same person uploaded the video on Instagram.
Amanda said that for eight days, she was not aware that there was a video of the incident.
The owner of the video immediately deleted the post but by then, it had already been shared.
“I felt bad that they had to make that video... they were making fun of me in the video,” Amanda said.
Authorities have identified the person who posted the video and those who shared it. Complaints will also be filed against them. (FROM AYB OF SUPERBALITA CEBU / RSR / LRC)
