Off-road race organizer fails to file defense counter-affidavit

AN OFF-ROAD race organizer has reportedly failed to file a counter-affidavit in the criminal charges filed against him for estafa under the Revised Penal Code and for violating the Anti-Bouncing Check Law during the preliminary investigation held before the Office of the Prosecutor in Angeles City on October 9, 2019.

Romac Services and Trading Co. Inc. finance manager Sheryl Y. Guevarra said Prosecutor Roberyn Joy M. Navarro denied off-road organizer Neil Michael Anthony T. Palabrica's request for additional time and a third opportunity to file his counter-affidavit, considering that the respondent was adequately notified of two settings for the preliminary investigation.

Romac Services and Trading Co. Inc. filed the complaint against Palabrica for his alleged failure to pay the emergency funds loaned to Palabrica for the Rainforest Challenge Global Series Philippines in August 2017.

The complaint affidavit by Guevarra further alleged that Palabrica "falsely and fraudulently pretended that he had the capacity to return the emergency cash advance of P400,000 within five days, and that he had receivables from the event sponsors -- a fuel company and tire company."

In addition, Palabrica's check to repay the loan was reportedly dishonored due to insufficiency of funds.

Navarro considered the complaint submitted for resolution by the Office of the Prosecutor.
