GIBASURA sa Regional Trial Court Branch 10 ang gipangayo ni kanhi mayor Tomas Osmeña nga temporary restraining order (TRO).
Gisuspenso usab ang hearing sa ilang gipangayo nga writ of preliminary injunction labot sa pagkahalin sa 46 ektaryas nga yuta sa South Road Properties niadtong 2015.
Gibaliwa ni Presiding Judge Soliver Peras ang gipangayo ni Osmeña, kinsa naila nga TRO kun Tomas dela Rama-Osmeña, gumikan sa iyang kapakyas sa pagpakita sa ebidensya subay sa iyang pangangkon nga kwestyonabli ang kontrata nga gisudlan sa City Government ug sa mga nakapalit nga land developers nga gilangkuban sa SP Prime Holdings Inc, Ayala Land Inc., Filinvest Land Inc., Cebu Holdings Inc. ug uban pa.
“Petitioner did not show that any damage he may suffer from the implementation of the questioned contracts meet the case law standard of grave and irreparable injury. There is no indication that any loss that may be borne from the City’s disposition of its property cannot be mathematically computed,” matod sa decision ni Peras.

Nimando si Peras sa motion to dismiss ug opposition apil ang ubang pleadings labot sa maong kaso pagduso para sa iyang pagpakanaog og desisyon.
Si Mayor Edgardo Labella kinsa maoy primary respondent sa kaso uban sa mga developer, nihulagway sa kadaugan sa mga Sugbuanon.
Matod ni Labella nga ang maong kaso susama ra sa kanhi kaso nga giduso ni Romulo Torres nga gi-dismiss usab sa RTC ug gibasura ang apelasyon sa Court of Appeals.
“No TRO for TRO. It has become a fait accompli. In several cases which were severally situated like the Romulo Torres cases. This is a victory for the people of the City of Cebu and again there will be no more legal impediment and no stopping of the development of the 26 hectare land which was under the consortium.
