Apan may gahom ba ang mayor sa pagpahamtang sa maong ban? Si Atty. Ian Kenneth Lucero, officer-in-charge sa Department of Interior and Local Government (DILG) – Cebu City, niingon nga way babag, way “legal impediment” sa mga mayor sa pag-ban sa mga turistang Insek sa pagsud sa syudad kon gikinahanglan.
Matod pa niya subay kini sa “general welfare clause” ubos sa Local Government Code of 1991 nga nagdelegar sa “police power” sa estado ngadto sa mga local government units (LGUs).”

Unsa man kining police power? Ang Korte Suprema, sa kaso nga Ermita Malate Hotel vs. City Mayor (July 31, 1967), niingon, “Police power is the power vested in the legislature by the Constitution to make, ordain, establish all manner of wholesome and reasonable laws for the good and welfare of the State and its people.”
Unsa man ang mga katuyoan sa police power? Subay sa kutay sa mga desisyon sa Korte Suprema, mao kining mosunod: (1) to promote the general welfare, comfort and convenience of the people; (2) to promote and preserve public health; (3) to promote and protect public safety; (4) to maintain and safeguard peace and order; (5) to protect public morals; and (6) to promote the economic security of the people.
Klaro nga ang police power naglakip sa pagpreserbar sa panglawas sa publiko. Busa mahimong i-ban sa mayor ang mga turistang Insek nga di na kinahanglan nga matakdan ang mga lomulupyo sa syudad sa novel corona virus gikan sa Wuhan, China.
