MGA agalon di makapugong sa ilang mga trabahante kinsa nanimuyo sa mga high-risk nga mga lugar sa coronavirus disease (Covid-19) sa pagtambong sa trabaho.
Kini maoy gibutyag sa City Legal Office (CLO) ning dakbayan sa Davao.
Sa legal nga opinyon nga gipagawas niadtong Mayo 25, si assistant city legal officer Osmundo Villanueva Jr. nagsulti nga "employers should allow said employees to report for work and subject them to periodic Covid-19 testing at their (employers) expense in accordance with Section VII of the same DTI-DOLE Interim Guidelines. This section even mandates that workers with negative tests shall continue to work."
Apan mga agalon mahimong magsuspende sa ilang mga trabahante pagtambong sa buhatan "physically" basta nagsagop sila og alternatibong work arrangements nga di kaltasan ang suweldo ug benepisyo niini.
"Employers are highly encouraged to allow these workers to do work from home arrangement. Work agreements should be developed to detail the deliverables from these employees and there shall be no diminution in wages and benefits," tin-aw pa niya, kon diin dugang niining gisulti nga naglakip kini sa "most at risk and vulnerable" nga mga trabahante.
"By adopting a company policy of refusing physical reporting of employees from high risk areas, the employer is legally bound to adopt an alternative work arrangement, preferably work at home, to ensure that such employees are not displaced and deprived of their income," sugyot ni Villanueva.
"The right of the employer is likewise fairly protected because under the scheme, the employee still has to render services to earn his wage. This is consonant with the declared policy of the state to afford protection to labor as well as the employer," dugang pa niya.
Sa iyang paghinabi sa Davao City Disaster Radio, gisulti ni Davao City Mayor Sara Duterte-Carpio nga ang maong hisgutanan gipadayag sa mga trabahante kinsa nanimuyo sa Barangay 23-C.
Matud niya nga mga trabahante giingong gidid-an nga mosulod sa ilang trabaho tungod gikan sila sa high-risk nga mga lugar.
Sukad Mayo 25, ang Barangay 23-C giisip nga "very high risk" barangay.
Samtang subling giklaro ni Duterte-Carpio nga ang paghimo og Covid-19 testing sa mga trabahante una mobalik sa trabaho di rekisito subay sa abiso sa Department of Health (DOH).
Giawhag sa mayor ang mga agalon nga motan-aw sa mga guidelines sa pagbalik og trabaho nga gitakda sa (DOH) Department Circular 2020-0220 kon makahukom sila nga i-test ang ilang mga trabahante gamit ang reverse transcription polymerase chain reaction (RT-PCR) o rapid antibody test.
