Yanson 4 lawyer 'misled the public'

THE lawyer of Vallacar Transit Inc. president Leo Rey Yanson said Thursday, June 4, that the lawyer of the Yanson 4 siblings misled the public about the truth on the issuance of the warrant of arrest against his clients.

Lawyer Gerry Llena, legal counsel of Leo Rey, said the warrant of arrest for grave coercion case against Roy Yanson, Emily Yanson, Ricardo Yanson Jr. and Celina Lopez, also known as the Yanson 4, has been issued by Judge Ambraham Bayona on March 10 after the court found probable cause and ordered for the issuance of the warrant against them.

"As a lawyer, I have been closely monitoring the case and check on the records of the court which should also be the role of their lawyers," Llena said.

He pointed out that the court has been lenient to the Yanson 4 because they were given the time to argue.

"They filed the Motion to Suspend Proceedings and Hold in Abeyance Issuance of Warrant on March 9 which is already moot because the warrant has been issued. Issuance and release of the warrant are two different things," the lawyer added.

The hearing was postponed on March 17 because the province was placed under the enhanced community quarantine.

On May 29, lawyer Shiela Sison, lawyer of the Yanson 4, did not take time to argue with me and instead insist to have me disqualified.

"I mentioned that there was already an order and their motion was already moot but she did not listen to me. I asked her, you're asking for the affirmative relief for you clients? That's elementary in the rules of procedure that before court could act on the your motion the court has to acquire jurisdiction which is also elementary in the courts procedure," Llea said.

He said that after the hearing, the court issued the warrant to the private complainant.

"It's the right of the private complainant to ask the police so long as the warrant is issued, it can be served any time of the day even on Sunday. There is an executive judge assigned on Sunday, lawyers know that," Llena said.

He also revealed that despite the small amount for the bail, the Yanson 4 has not posted bail.

"The CIDG reported that the Yanson 4 went abroad. In other words, that obviously means that they are aware of the issuance of the warrant against them," Llena added.
