SUGOD karong Nobyembre 2, ang mga trial courts sa Pilipinas makapahamtang na sa silot nga community service inay sa pagkapriso alang sa mga ginagmay nga krimen nga gisilotan sa pagkabilanggo hangtod sa unom ka buwan.
Ang Korte Suprema mipahibawo nga ipatuman na ang Republic Act No. 11362, ang Community Service Act, nga gipirmahan ni Presidente Rodrigo Duterte niadtong Agusto 8, 2019. Giaprobahan na ang mga lagda sa maong balaod apan wa pa kini ipagawas.
Ang community service mohulip sa pagkapriso niadtong gisilotan og arresto menor ug arresto mayor. Ang arresto menor mao ang pagkabilanggo gikan sa usa ka adlaw ngadto sa 30 ka adlaw. Samtang ang arresto mayor mao ang pagkapriso gikan sa usa ka buwan ug usa ka adlaw ngadto sa unom ka buwan.
Gisal-ot sa RA 11362 ang Article 88a sa Act No. 3815, Revised Penal Code of the Philippines, nga nagkanayon, “Art. 88a. Community Service.— The court in its discretion may, in lieu of service in jail, require that the penalties of arresto menor and arresto mayor be served by the defendant by rendering community service in the place where the crime was committed, under such terms as the court shall determine, taking into consideration the gravity of the offense and the circumstances of the case, which shall be under the supervision of a probation officer.”
Agad sa kabubut-on sa huwes, inay prisuhon ang masentensiyahan og arresto menor ug arresto mayor, mosilbi na lang siya didto sa komunidad nga nahitaboan sa krimen samtang ubos siya sa superbisyon sa usa ka probation officer.
Ang korte maoy mositar kon pila ka oras ang community service. Samtang ubos sa community service, ang defendant moagi og rehabilitative counseling sa usa ka social welfare and development officer sa iyang lungsod o syudad inabagan sa Department of Social Welfare and Development (DSWD).
Usa ka konsiderasyon sa husgado nga community service na lang inay prisuhon ang defendant mao nga dako ang posibilidad nga ang tawo di na molapas sa balaod samtang nag-alagad sa komunidad.
Unsa man kining community service? Ang balaod nag-ingon, “Community service shall consist of any actual physical activity which inculcates civic consciousness, and is intended towards the improvement of a public work or promotion of a public service.”
Ang molapas sa lagda sa community service mahimong sikupon aron paserbisyuhon sa kinatibuk-an sa iyang silot sa prisuhan o sa iyang balay, house arrest, ubos sa Article 88, Revised Penal Code.
