Barrita: Pope Francis pabor sa same-sex civil unions?

GI-ENDORSO in Pope Francis ang same-sex civil unions alang sa di mahimong magminyo sama mga homosexual, sa lalake sa lalake ug babaye sa babaye. Gipadayag kini sa Santo Papa sa usa ka interview sa documentary nga giulohan og “Francesco,” nga unang gisalida niadtong Oktobre 21 sa Rome Film Festival.

“Homosexual people have the right to be in a family. They are children of God. You can’t kick someone out of a family, nor make their life miserable for this. What we have to have is a civil union law; that way they are legally covered,” matod pa ni Pope Francis.

Ang pamahayag sa Santo Papa, nga gitumong sa paglikay sa diskriminasyon, tukion pa sa mga opisyal sa Vatican. Apan dako kini og epekto alang niadtong niduso sa Kongreso og balaudnon alang sa same-sex-marriage. Kon di mapasar ang balaod sa same-sex marriage, hayan same-sex civil union na lang.

Atong tukion kining pipila ka mga probisyon sa Article XV (The Family) sa 1987 Constitution:

“Section 1. The State recognizes the Filipino family as the foundation of the nation. Accordingly, it shall strengthen its solidarity and actively promote its total development.”

“Section 2. Marriage, as an inviolable social institution, is the foundation of the family and shall be protected by the State.”

“Section 3. The State shall defend: (1) The right of spouses to found a family in accordance with their religious convictions and the demands of responsible parenthood.”

Klaro nga wa maghisgot ang Batakang Balaod nga kinahanglang lalake ug babaye ang magminyo kay ang gigamit nga pulong mao ang “spouse,” way gender. Didto na sa Family Code ibutang nga ang lalake ug babaye lang ang mahimong magminyo.

Ang Article 1 niini nag-ingon, “Marriage is a special contract of permanent union between a man and a woman entered into in accordance with law for the establishment of conjugal and family life. It is the foundation of the family and an inviolable social institution whose nature, consequences, and incidents are governed by law and not subject to stipulation, except that marriage settlements may fix the property relations during the marriage within the limits provided by this Code.”

Samtang ang Article 2 nagkanayon, “No marriage shall be valid, unless these essential requisites are present: (1) Legal capacity of contracting parties who must be a male and a female; and (2) Consent freely given in the presence of the solemnizing officer.”

Usa ka Atty. Jesus Nicardo Falcis III nipasaka og petisyon sa Korte Suprema nga ideklarar nga unconstitutional ang Article 1, 2, 46 (4) ug 55 (6) sa Family Code. Apan gisalindot sa hingpit sa Korte Suprema niadtong Enero 6, 2020, ang maong petisyon nga kon giaprobahan pa, magtugot unta nga magminyo ang lalake ug lalake ingon man ang babaye ug babaye dinhi sa Pilipinas.
