NAKABANTE ang Cebu City north district sa pagtaliwan ni Kongresista Raul del Mar niadtong Nobyembre 16, 2020. Siya nag-alagad sa maong distrito sud sa 27 ka tuig, duha ka tuig una matiwas ang ikasiyam niyang termino (1987-1998; 2001-2010; 2013-2022).
Kon ilakip pag-ihap ang gialagaran sa iyang duha ka mga anak, ang mga Del Mar nakaalagad sa maong distrito sud sa 11 ka termino o 33 ka tuig, lakip sa tagsa ka termino nila ni Dr. Raoul del Mar (1998-2010) ug Rachel “Cutie” del Mar (2010-2013).
Unsa man ang balaod kon mabakante ang usa ka distrito? Ang Section 9, Article VI, 1987 Constitution, nagkanayon, “In case of vacancy in the Senate or in the House of Representatives, a special election may be called to fill such vacancy in the manner prescribed by law, but the Senator or Member of the House of Representatives thus elected shall serve only for the unexpired term.”
Mahimong ipatawag ang usa ka special election aron pilion ang ihulip sa nabakanteng distrito ug ang mapili mag-alagad sa unexpired term. Subay niini, gipasar ang Republic Act (RA) No. 6645, ang balaod sa paghulip sa vacancy sa Kongreso, niadtong Disyembre 28, 1987.
Ang Section 1 niini nagkanayon, “In case a vacancy arises in the Senate at least 18 months or in the House of Representatives at least one year before the next regular election for Members of Congress, the Commission on Elections, upon receipt of a resolution of the Senate or the House of Representatives, as the case may be, certifying to the existence of such vacancy and calling for a special election, shall hold a special election to fill such vacancy.”
Ipatawag sa Comelec ang usa ka special election kon adunay nabakante sa Senado labing menos 18 ka buwan sa di pa ang sunod nga regular election ug dunay nabakante sa House labing menos usa ka tuig sa di pa ang sunod nga regular election.
Apan di dayon makapatawag og usa ka special election ang Comelec. Kinahanglan pa ang usa ka resolusyon sa Senado ug sa House nga adunay bakante ug nagpatawag sa maong special election.
Wa na kinahanglana ang resolusyon sa Senado ug sa House nga adunay bakante ubos sa RA No. 7166, ang Synchronized National and Local Elections Law, nga gipasar niadtong Nobyembre 26, 1991.
Ang Section 4, second paragraph niini, nagkanayon, “In case a permanent vacancy shall occur in the Senate or House of Representatives at least one year before the expiration of the term, the Commission shall call and hold a special election to fill the vacancy not earlier than 60 days nor longer than 90 days after the occurrence of the vacancy. However, in case of such vacancy in the Senate, the special election shall be held simultaneously with the next succeeding regular election.”
Kon nabakante usa ka tuig sa di pa mo-expire ang termino, ipahigayon ang special election sa di mas sayo kay sa 60 ka adlaw ug di mas dugay kay sa 90 ka adlaw gikan sa pagkabakante.
