No curfew on December 24, 31

BACOLOD City Mayor Evelio Leonardia issued Executive Order No. 82 suspending the non-social period/curfew hours on December 24 and 31, 2020 in observance of Filipino customs and traditions of celebrating Christmas and to welcome the New Year, as acknowledge under City Ordinance No. 947, Series of 2020.

Leonardia, who signed the EO on December 20, said the suspension of the curfew hours/non-social period shall be from 11 p.m. of December 24 until 3 a.m. of December 25, and from 11 p.m. of December 31 until 3 a.m. of January 1, 2021.

He said in celebration of Christmas Eve and New Year’s Eve, respectively, only. The application of such suspension shall ipso facto expire after such designated dates and time, and are not to be extended nor made recurring unless authorized under another Executive Order.

In the intention of the mayor to provide the chance to the Bacolenos to exercise time-honored customs and traditions during the 2020 Christmas Season, Leonardia said he conducted a series of consultations with the Vice Mayor, the members of the Sangguniang Panlungsod, barangay officials, and the City’s Emergency Operations Center (EOC) Task Force, to determine the feasibility, practicality, and safety of such policies on Christmas Eve and New Year’s Eve.

“The data of the EOC on our Covid-19 cases has shown very significant drops and improvements over the past several weeks on the number of reported daily positive cases, recovery rates, hospital capacity utilization rate, and active cases, among others, have convinced us that suspending the curfew hours on December 24 and December 31 is now an option we can afford to take provided all other existing health protocols shall remain in full force and effect,” he said.

Section 3 of CO 947 stated that the duration of the emergency authority of the City Mayor shall be concurrent with the community quarantine period declared by the National Government/National-IATF which, at present, has been practiced and implemented in the total calendar days of the given month, or for the purpose of this ordinance, such emergency authority may be exercised in the maximum period of thirty one (31) days in a given calendar month.

Notwithstanding the policy on curfew hours provided in City Ordinance No. 934, Series of 2020, the City Mayor may exercise his emergency power to implement the curfew period in a given community quarantine status provided for in Section 3 hereof, CO 947 further stated.

Section of the EO No. 82 also states that the strict home quarantine of vulnerable persons by reason of age, comorbidities, illness, and those covered in the national policy of the Department of Health and/or National and Local IATF shall continue to be enforced. All other prohibitory acts under Executive Order No. 73, Series of 2020, dated November 30, 2020, except the suspension of the curfew hours/non-social period provided in Section 2 hereof, shall continue to be in full force and effect. Likewise, the minimum health protocols requiring the wearing of face masks face shields, and social distancing in public places must be strictly observed.
