Mopadayon ang Senado sa ilang imbestigasyon sa pagbakuna batok sa Covid-19 sa mga sakop sa Presidential Security Group (PSG) ginamit ang bakuna sa Sinopharm, usa ka pharmaceutical company sa China, nga wa pa maaprobahing gamiton dinhi sa Pilipinas sa Food and Drug Administration (FDA).
Apan si Presidente Rodrigo Duterte miingon nga adunay “crisis” nga mahitabo kon ipatawag sa Senado ang mga opisyal sa PSG. Sa usa ka televised address sa Lunes sa gabii, gimandoan sa presidente si PSG commander Brig. Gen. Jesus Durante III sa di pagtuman sa summons gikan sa Senado.
Matod pa sa Pangulo, “I will not allow it. I will go to Congress and get them ... If you do that, there will be a little crisis. It’s in your hands. I’m prepared to defend my soldier[s]. I will not allow them for all their good intentions to be brutalized in a hearing.”
Si Senate Minority Leader Franklin Drilon miingon nga legal ang pagdangop sa Presidente sa executive privilege ubos sa Executive Order No. 464 nga giluwatan niadtong 2005 ni kanhi Presidente Gloria Macapagal-Arroyo. Ubos niini ang mga pangulo sa mga executive departments, kinahanglan og pagtugot sa Presidente aron moatubang sa bisan unsang congressional investigation.
Apan si Senate President Vicente Sotto III niingon nga wa silay tumong nga ipatawag ang PSG sa imbestigasyon mahitungod sa programa sa gobyerno sa pagbakuna batok sa Covid-19.
Ang FDA, National Bureau of Investigation ug Bureau of Customs adunay ilang imbestigasyon sa illegal nga pagsulod sa nasod sa bakuna batok sa Covid-19. Ang mga nahilambigit niini hayan nga nakalapas sa Republic Act (RA) No. 9711, ang Food and Drug Administration Act (FDA) of 2009. Ang maong balaod nag-amendar sa RA No. 3720 ug nag-usab sa ngan sa Bureau of Food and Drugs (BFAD) ngadto sa FDA.
Gidili sa Section 11 (k), RA No. 3270, as amended by Section 10, RA No. 9711, kining mosunod, “The manufacture, importation, exportation, sale, offering for sale, distribution, transfer or retail of any drug, device or in-vitro diagnostic reagent; the manufacture, importation, exportation, transfer or distribution of any food, cosmetic or household/urban hazardous substance; or the operation of a radiation or pest control establishment by any natural or juridical person without the license to operate from the FDA required under this Act.”
Ang silot sa nakalapas niini mao ang pagkapriso gikan sa usa ka tuig apan di mosobra sa 10 ka tuig ug multa nga di momenos sa P50,000 apan di mosobra sa P500,000. Mahimong dungan nga ipahamtang ang pagkapriso ug ang multa segun sa hukmanan.
Kon ang nakalapas mao ang manufacturer, importer o distributor, ang silot mao ang pagkapriso sa labing mernos lima ka tuig apan di molabaw sa 10 ka tuig ug multa nga labing menos P500,000 apan di molabaw sa P5,000,000, pun-an pa sa multa nga uno porsento sa kantidad sa produkto.
Kon ang nakalapas usa ka foreign national, ipuno sa iyang sentensiya ang pag-deport kaniya sa nasod diin siya gikan nga di na moagi pa og deportation proceedings human niya maserbisyohi ang iyang sentensiya.
