Osmeña ‘willing to go’ to SC over SRP lot sale

THE camp of former Cebu City mayor Tomas Osmeña will file a motion for reconsideration after the Regional Trial Court (RTC) Branch 10 dismissed the case he filed over the “illegal” sale of South Road Properties (SRP) lots.

Amando Virgil Ligutan, Osmeña’s legal counsel, said they are willing to fight the case up to the Supreme Court.

Ligutan questioned the statement of the RTC Branch 10 that Osmeña has no legal standing to question the contract the City had entered into with the developers.

“A former mayor who has been fighting for SRP all his life has no standing to question the anomalous contract?” asked Ligutan. “Who has standing then? Virtually zero. This is not correct.”

The former mayor’s counsel also questioned the court for stating that no disbursement of public funds was involved when Osmeña himself signed the checks for the payment of the SRP loan.

“So, it does not make sense to say there is no disbursement of public funds in this case,” said Ligutan.

Ligutan said Osmeña will not give up.

“We are just beginning. We are just warming up,” Ligutan said in a statement on Sunday, Jan. 24, 2021.

“The Tomas Osmeña that I know does not give up, not for the Cebu City residents he has been fighting for all his life,” he added.

The RTC Branch 10 recently dismissed the petition and denied Osmeña’s application for a temporary restraining order and writ of preliminary injunction. (JJL)
