ANG Office of the Cebu City Prosecutor nakakita og probable cause sa pag-prosecute sa duha ka mga doktor sa Chong Hua Hospital nga nag-atiman ug nihatag og medical care ni anhing Barili mayor Marlon Garcia sa wala pa kini nitaliwan niadtong Septiyembre 6, 2020.
Sa 34-ka-pahina nga resolusyon, pinetsahan og Marso 1, 2021, gilagdaan ni Asst. City Prosecutor Verna Merelos ug giaprobahan ni Cebu City Prosecutor Liceria Lofranco-Rabillas ug Deputy City Prosecutor Maria Luisa Ratilla, ang Office of the Cebu City Prosecutor nirekomendar sa pagpasaka og kaso nga reckless imprudence resulting to homicide batok nila ni Dr. Elfleda Hernandez ug Dr. Yvonne Bettina Montejo.
Bahin sa reklamo batok sa Chong Hua Hospital, ang Office of the City Prosecutor nagkanayon nga ang preliminary investigation limitado lang sa giingong criminal and civil aspects batok sa duha ka mga doktor ug dili maapil sa liability for damages ang ospital, sumala sa Office of the Cebu City Prosecutor.
Si Jima Tiano-Garcia, asawa ni anhing Barili Mayor Garcia nipasaka og pormal nga reklamo nga medical negligence (ubos sa Title XIV of the Revised Penal Code and Other Related Penal Legislations) batok nila ni Hernandez ug Montejo human sa kamatayon sa iyang bana.
Base sa death certificate, ang namatayan sa mayor mao ang “septic shock secondary to catheter related blood stream infection, ventilator associated pneumonia (with an antecedent cause of catheter related bloodstream infection ventilator associated pneumonia and an underlying cause of Covid Confirmed Pneumonia Recovered.”
Ang Office of the Prosecutor nagkanayon nga ang nisunod nga affidavits ni Jima “evidently show the intent of the complainant and her family in the filing of criminal complaint for medical negligence.”
Nagbaliwala kini sa gipamahayag sa gipangkihang doktor nga ang affidavit ni Jima wala mipadayag sa pagkiha ni Dr. Montejo sa kasong medical negligence, apan usa ka hangyo sa imbestigasyon aron ang mga Garcia masayod sa aktuwal nga rason nga nagpaluyo sa kamatayon ni Marlon.
Ang prosecutor nagkanayon nga judicial affidavit ni Gov. Gwendolyn Garcia ug ni Atty. Winston Garcia, mga igsuon ni Marlon, dili usab maisip nga hearsay sa context sa imbestigasyon.
“It is worthy to note that during the entire time of the confinement of Mr. Garcia, witness Gov. Garcia was never at the hospital. In fact, her affidavit states that she closely monitored
and was regularly updated of the status of her two brothers who were both admitted at the same hospital at about the same time. But the fact that she was merely informed of the status of her brothers does not, ipso facto, render allegations in her affidavit, hearsay,” tipik sa prosecutor’s findings.
Dugang sa prosecutor, “the respondent’s defenses of denial are all evidentiary in nature and should be ventilated in a full blown trial.”
“Hence, their decisions not to discharge Mr. Garcia was arrived at in consultation with each other. And their decision not to discharge Mr. Garcia has been challenged as one of the causes of the death of Mr. Garcia,” dugang sa findings sa proscutor. (WBS)
