The North Face vs. The Trap Face

OUTDOOR apparel company The North Face has filed with the North Carolina Business Court a trademark infringement suit against the owners of The Trap Face who sell urban-themed T-shirts. The suit claims that The Trap Face infringed and copied The North Face’s trademark composed of the words “The North Face” together with a half dome logo on a red background. The Trap Face counters that: (a) its logo is rectangular and shaped like a house while The North Face logo is curved, (b) the red background of its trademark has a different shade vis-à-vis that of The North Face, and (c) it is going after the “urban” market while The North Face is focused on outdoor activities. The suit also says that The Face Trap is tarnishing The North Face brand which the latter has built since 1968. (www.bizjournals.com)
