Ybañez files motion for reconsideration against neglect of duty

BINALIW, Cebu City barangay councilor Daisy Ople Ybañez said her camp already filed a motion for reconsideration for the Feb. 22, 2021 decision of the Office of the Ombudsman finding her guilty for simple neglect of duty.

The complaint against her was filed by Binaliw Barangay Captain Viviane Ruste.

"It is our legal position that I am not guilty of any misconduct or violation of any law. I have been a dedicated public servant with proven track record," she told SunStar Cebu in a chat interview.

Ybañez said she believes that she is a victim of politicking.

Department of the Interior and Local Government (DILG)-Cebu City in charge and lawyer Ian Kenneth Lucero, in an interview with Cebu media on Friday, Sept. 24, confirmed that they implemented two suspension orders from the Office of the Ombudsman against two local officials for simple neglect of duty.

He, however, refused to name the two local officials during the interview with the Cebu press.

He said in both orders, it is not the DILG who is the complainant but private parties.

"Siguro bahin sa mga services sa barangay," he said.

However, based on a copy of a memorandum signed by DILG 7 director Leocadio Trovela addressed to Cebu City Mayor Edgardo Labella and dated Sept. 17, which was obtained by SunStar Cebu, the Ombudsman imposed a one month suspension order against Binaliw Councilor Ybañez.

SunStar Cebu has yet to get the name of the other one local official whom Lucero said is also subject of a suspension order. (WBS)
