Kin of man crushed by truck in road accident to charge ‘reckless’ driver

HE HAD a name—that motorcycle driver who met his untimely death after he was run over by a 10-wheeler truck at Marcelo Fernan Bridge in Barangay Umapad, Mandaue City on Saturday, Oct. 16, 2021.

Rudy Amistad was his name. He was 52.

His death devastated his family as he had been about to travel to the United States with his wife. They were supposed to live with their child working there as a nurse, said Lt. Col. Franco Rudolf Oriol, Mandaue City Traffic Group chief.

Amistad’s family from Barangay Pajac, Lapu-Lapu City told Oriol on Monday, Oct. 18, that they will push through with the filing of a criminal complaint against the truck driver, Aldwin Hermosilla, who was detained in Opao Police Station after the road incident.

Oriol said they received a report that Hermosilla’s employer would try to talk things out with Amistad’s family; however, Oriol said even if the victim’s family would not push through with the filing, the traffic group would still lodge the complaint before the prosecutor’s office.

The traffic group planned to file the complaint, reckless imprudence resulting in homicide, on Monday afternoon.

Security camera footage shows Hermosilla’s error—while Amistad is driving his motorcycle ahead of the truck, Hermosilla tries to overtake. The truck, which carries sand, then hits the motorcycle and runs over Amistad, instantly killing him.

Oriol said there was clear negligence on Hermosilla’s part.

In an interview with Superbalita Cebu, Hermosilla said he never saw Amistad. He described the motorcycle driver’s death as an accident.
