Petitioners score delays in Marcos case

PETITIONERS looking to deny the presidential bid of Ferdinand "Bongbong" Marcos Jr. assailed on Saturday, November 27, the delays faced at the Commission on Elections (Comelec).

In a statement, the petitioners, led by Fr. Christian Buenafe et al, said they oppose the "indefinite deferral" of the mandatory submission of the memoranda of the opposing parties.

"Petitioners take exception to the indefinite deferral and the supposed reasons therefor and will avail of appropriate remedies to put on record their objections thereto," said the petitioners.

They said this is because they believe that there are no adequate reasons to defer the proceedings, especially with it being indefinite.

"At the conclusion of the preliminary conference, petitioners sought to have both parties submit their respective memorandum by Monday, November 29, three days after the conference, as indicated in the Comelec's own Notice and Summons," said the petitioners.

"Surprisingly, the Comelec Division Clerk, citing 'pending incidents,' deferred the submission of memorandum unilaterally, without any motion from the parties and despite vehement objections by the petitioners," the group added.

On Friday afternoon, November 26, Comelec Spokesman James Jimenez said the poll body has yet to set the deadline for the submission of memoranda.

This was supposedly due to the "pending incidents" that needed to be resolved before a date is set.

One pending issue is the motion for the holding of a physical oral argument sought by the camp of Marcos.

Another issue raised, he said, is the pendency of two petitions-for-intervention relative to the case against Marcos.

The preliminary conference was earlier expected to result in the setting of the deadline for the submission of the written memoranda to the Comelec Second Division.

Upon submission of the respective memoranda, the case is already deemed submitted for resolution of the Comelec. (HDT/SunStar Philippines)
