Pag-dismiss sa kaso batok ni Garcia gidasunan sa SC

“Justice has prevailed, as always.”

Kini maoy pamahayag ni Cebu Governor Gwendolyn Garcia subay sa uwahing ruling sa Supreme Court nga nagsuporta sa desisyon sa Court of Appeals (CA) nga i-dismiss ang kasong administratiba nga gipasaka batok sa gobernador kalabot sa kontrobersiyal nga Balili property.

Ang Labaw nga Hukmanan nipagawas sa 11 ka panid nga ruling sa Septiyembre 14, ug gi-publikar sa Nobiyembre 24.

Ang desisyon giluwatan human sa petisyon nga giduso sa Office of the Ombudsman, nga naghangyo sa Supreme Court sa pagsusi sa desisyon sa Court of Appeals labot sa pagka-abswelto kang Garcia ug sa laing 10 ka mga opisyal sa Kapitolyo.

Si Garcia ug ang kaubang mga opisyal sa Kapitolyo, gipasakaan og kasong grave misconduct may labot sa pagpalit sa Balili Property sa Dakbayan sa Naga niadtong 2009.

Ang kampo ni Garcia nidangop usab sa CA nga ni-pabor kaniya.

Nalakip sa argument nga giisa sa CA mao ang condonation doctrine nga gisubay sa ruling sa Korte Suprema.

Gipasabot niini nga bisan kon giabandonar na sa SC ang nahisgutang principle sa 2016, mahimo gihapon nga magamit ang maong doktrina sa kaso ni Garcia sanglit gipasaka ang administrative complaints sa 2010 nga epektibo pa ang doktrina.

“Here, the three complaints for grave misconduct were filed against respondent (Garcia) and other individuals prior to her reelection as governor of the Province of Cebu in 2010. Since the events that transpired here occurred prior to the finality of (of the decision on condonation) on April 12, 2016, respondent can still avail herself of the benefits of the condonation doctrine as a consequence of her reelection in 2010,” matod sa Korte Suprema.

“Verily, it is incorrect for the Omb to argue that the condonation doctrine merely erases the penalty and not the offense. To repeat, the condonation doctrine obliterates the offense and, consequently, the liability as well,” dugang niini.

Subay niini, malipayong gi-dawat ni Garcia ang bag-ong kalamboan ug nagtuo siya nga sukad, magpabilin ang hustisya sa kamatuoran.

“And yet again, justice has prevailed as always the truth will set us free,” matod sa gobernador.
