Apple vs. Apple-Man

Ukrainian movie director Vasyl Moskalenko made an action-comedy movie about a superhero who can levitate apples. It is a low-budget film that was crowdfunded through Kickstarter. The movie’s title is “Apple-Man.” Moskalenko filed with the US Patent and Trademark Office an application to register “Apple-Man” as a trademark for motion picture films about superheroes, e-books in the field of comics and graphic novels, video and computer game programs, among others. Apple Computers filed an opposition to the “Apple-Man” trademark application, claiming that the public will erroneously believe that “Apple-Man” is associated with Apple Computers and that the Apple brand will be diluted. Apple also avers that “Apple-Man” adopts the world-famous “Apple” trademark and just added the generic word “man.” Moskalenko’s lawyers say that the public will not be misled by the movie.
