Wala matarog ang mga opisiyal sa Probinsya sa Sugbo sa tulo ka adlaw nga ultimatum nga gihatag sa Department of the Interior and Local Government (DILG) aron mohimo og kausaban sa executive order ug ordinansa sa Probinsya kalabot sa optional nga pagsul-ob og face mask sa mga lugar nga hawan ug well-ventilated sa lalawigan.
Kini maoy gipahibawo ni Cebu Governor Gwendolyn Garcia atol sa pakighinabi sa mga tigbalita kagahapon, Hunyo 17, 2022.
“We will stand by with our ordinance, adopting my EO on rationalizing the wearing of face masks in well-ventilated areas,” matod ni Garcia.
“Its very clear unless the Provincial Ordinance 2022-03 is declared illegal or ultra viresby the proper court of law not by the outgoing secretary of the Interior Local Government, not by the IATF, but by the proper court of law. So here in the province of Cebu the ordinance that rationalizes the use of face mask stands. My heart bleeds for the PNP because they are being given orders that have no legal basis,” dugang ni Garcia.

Ang mga opisiyal sa Kapitolyo nisubli nga adunay legal basis ang giluwatan nga executive order ni Garcia ug ang ordinansa.
Dugang ni Sepulveda nga kon aduna may pag kwestyon, mas maayo nga moadto sa korte.
Gibarugan niini nga aduna’y legal nga basehan ang lokal nga ordinansa kon itandi sa Executive Order (EO) No. 151 nga giluwatan ni Presidente Rodrigo Duterte sa 2021.
Giingong ang gihimong basehan sa pagpatuman sa EO 151 ang Republic Act 1132 (Mandatory Reporting of Notifiable Diseases and Health Events of Public Health Concern Act) diin gitagaan ang Department of Health ug ang iyang local counterparts og gahum sa pagpatuman alang sa rapid containment, quarantine and isolation, ilabi na sa Covid-19.
Gipasabot sa abogado nga ang EO sa Presidente di balaod sanglit ang gitamdan ang RA 11332.
Alang sa Kapitolyo, wala usab silay nalapas sanglit ang nahilatid sa EO 151 wala magpasabot sa pagpatuman sa maong republic act.
“The provincial ordinance if you carefully read, follows the national policy of the use of face mask. Mandatory on indoor spaces. That is why this law EO 151 gibutang nga respecting the rights of people to liberty, bodily integrity while maintaining and preserving public health. That is why in open and well ventilated spaces, we leave it up to our constituents to decide for himself...” matod ni Sepulveda.
Nagtuo si Sepulveda nga klaro nga wala mapatuman ang RA 11332 sanglit wala mahilakip ang local counterparts sa Department of Health sama sa local government offices sa pagkonsulta sa ilang mga desisyon ug direktiba kalabot sa pandemya.
“The one interior secretary is claiming to be, that was approved for implementation by EO 151. first question, is it a product of strong collaboration of national and local government health agencies as mandated by Republic Act 11332? No, we all know that. The IATF is a taskforce composed exclusively of national offices or agencies. No participation or whatsoever of the local government or the local counterparts.... the glaring absence of the local health authorities also known as the local counterparts in all the proceedings concerning the formulation, creation and enforcement of the subject guidelines renders it in fact inconsistent or violative of the said law. Remember, under the said law the power and authority rest on the DOH and the local counterparts. Sad to say or I’m happy to know wa maapil ang Interior Secretary, but that’s not me, it’s the law. The law that they’re saying the basis of EO 151,” matod ni Sepulveda.
Si Interior Secretary Eduardo Año una nangg nagkanayon nga ang EO ni Garcia ug ordinansa sa Hunta Probinsyal makamugna og “kalibog” sa mga tawo.
Apan si Sepulveda nagkanayon, wala naglibog ang mga Sugboanon ug nitumbok nga gani ang mga mayor sa Probinsya pinaagi sa League of Municipalities of the Philippines (LMP- Cebu Chapter) ug bisan ang Philippine Councilor’s League sa Probinsya sa Sugbo nagkahiusa sa pagpaluyo sa iyang giluwatan nga executive order. /
