IP Rep reminds public anew: Ancestral domain not for sale

MANDATORY Representative of the Indigenous People, Datu Rodolfo Mande, clarified ancestral domain title is meant for the tribal community and not a personal property of an individual that could be sold to anyone.

“Matagtribo nato dire, para sa kasayuran sa tanan, na-award na ang five kantis, lima ka tribo nga naa na gyud og kanti [serves as land title], kaso lang property ni sa tanan, kaya gani nga gitawag nga Obo-Manuvu, Tagabawa, Ata, Matigsalug ug Klata kay mao nay nakapangalan walay nabanggit diha nga isa ka-apelyido (Our tribal groups there, for the information of everyone, have been awarded of a land title, but the property is for the community that’s why it is named as Obo-Manuvu, Tagabawa, Ata, Matigsalug and Klata and no last name has been indicated),” Mande said in an interview with Davao City Disaster Radio on July 12, 2022.

Mande said that the ancestral domains now had a lot of intruders and built their properties in the area.

“Niabot na gyud ang panahon nga nagyagaw na ug di masabtan, isa ka punto nga naay nisulod ug nidaghan na gyud karun, taod-taod makita nato nga mushroom na gyud ang bukid kay murag nagkaanam na karun mag sige’g tinundugay didto na commercialized na ang uban (It has come to a point that there are a lot of problems in the area because there are intruders who managed to get in the vicinity, and later on we’ll see that the mountain is being commercialized),” Mande said.

However, Mande said there is no law that states that outsiders are prohibited to enter the premises.

“Di man gyud totally nga gibawalan ang mga tao nga mosulod didto, mohangayo nga magtukod og balay ang naproblema lang karun sa kasamtangan kay murag mahurot man pud, kana lang ang problema, daghan na ang giganahan (It is not prohibited to get inside like if they will ask to build a house. The problem right now is that, they almost occupied all the space since they figured out it's nice to live there),” Mande said.

He also said the transfer of rights is legal.

“Ato ning klarohon, naay transfer of rights sa mga gusto para pud maka-farm, para sa mga taga syudad (We need to clarify this, there’s a transfer of rights for those from the city who wanted to farm),” Mande said.
